1. The Prepaid Calling Account and service (hereinafter called "Prepaid
account") is made available to you by MeaPhone.com. By using your Prepaid
account, you acknowledge your receipt of and agreement with these Terms and
Conditions and all privacy policies which MeaPhone.com may amend from time
to time without prior notice to you but by posting such amendments on this
site. Your continued use of the Prepaid account after being given notice of
any amendments hereto shall be construed as your acceptance of such
amendments.
2. You hereby authorize MeaPhone.com to deduct any charges incurred
from the use of your Prepaid account from your Prepaid Calling Card
(hereinafter called "Credit": only for payments made via Credit Cards). You
may use the Prepaid account only so long as your account remains valid.
MeaPhone.com reserves the rights at any time, without prior notice, to
revoke, withdraw or terminate the services, the Prepaid account if it, in
its sole discretion, deems appropriate. Our authorized on-line credit card
payment processors may accept or reject your application at their
discretion, MeaPhone.com reserves the right to reject your application even
if it has been approved by the credit card processing companies and/or may
request additional information from you such as a photocopy of your physical
credit card and/or a recent bank statement showing your name (s), address
and any necessary information related to your credit card and building
society (Your bank).
3. Charges for Prepaid services will be rated and charged by
MeaPhone.com in US dollars at a flat rate per minute (as provided in our
rate list). Our rates are calculated at six-second increments. Rates for
calls placed to cellular phones will be billed an additional surcharge for
airtime (according to rate table). The amount debited will include any
applicable taxes, and will be shown in the currency provided for in your
charge. Notwithstanding the aforesaid, all prices are subject to change
without prior notice.
4. You are responsible for safe keeping the confidentiality of your
account number and condition of your Prepaid Calling Card. MeaPhone.com will
not be responsible for any loss or damage suffered or incurred by you due to
any loss or damage or wrongful use of your Prepaid account or the Prepaid
Calling Card howsoever arising.
5. Prepaid Calling Card PIN codes are valid for a certain period of
time from the time of activation of your Prepaid account. The Prepaid
account and the Prepaid Calling Card are issued on a strictly No Refunds
Policy. MeaPhone.com shall not be liable to refund any monies to you
arising from a loss or damage or otherwise inability to use the Prepaid
Calling Card and/or the Prepaid account.
6. The user understands that MeaPhone.com, in some cases uses public
Internet lines to complete calls and while all service on the network is
generally reliable, customers may experience some packet loss and delay in
the transmission of messages using the Prepaid account and/or the Prepaid
Calling Card. MeaPhone.com shall not be liable or responsible for any loss
or damage arising from or as a result of (directly or indirectly) such loss
or delay.
7. MeaPhone.com won't, in any case refund any purchase made on-line
where the calling account information have been sent to the customer,
however, if the account presents any defect, an eventual replacement will be
made available to the customer with regard to investigation circumstances
and proof of normal use. Promotional or basic accounts are not refundable in
any case resulting from the customers' Internet Service Provider disruption
of service, hardware or software issues installed on the customer's
machines, restriction of voice transmission OR by any restrictions set by
the corporate networks such as Governments, Institutions and any similar
networks. Furthermore, the customer alone is responsible for making the
necessary technical requirements on his/her computer that hosts MeaPhone
Dialer in order to meet the best conditions for the installation. In this
regards, it is observed that some computers operating over Windows 2000
system may not be able to run MeaPhone WorldCall application properly due to
conflicts encountered in the Internet connection security blocking some of
the TCP/UDP ports necessary for Voice communications over IP networks.
Therefore, the customer is made aware that such incident is independent of
MeaPhone and its applications or services, and a refund caused by such a
case can't be initiated.
8. The products, services and all information and materials made
available hereunder, including without limitation the Prepaid Account and
the Prepaid Calling Cards are provided on an "as is" basis with no warranty
whatsoever. To the maximum extent allowed under law, MeaPhone.com disclaim
all representations and warranties expressed or implied, with respect to
the products and services provided by MeaPhone.com and with respect to such
information and materials including but not limited to warranties of
merchantability, fitness for a particular purpose, title, non-infringement,
freedom from computer viruses, and implied warranties, arising from course
of dealing or course of performance. In no event shall MeaPhone.com be
liable for any damage or loss whatsoever, including without limitation
direct, indirect, special, punitive, incidental, consequential or exemplary
damages, or any loss of profits, or other economic loss arising from or in
connection with any products and services offered by MeaPhone.com.
MeaPhone.com will not be liable or responsible in any way whatsoever for:
any loss or corruption of information howsoever caused, whether
as a result of any interruption, suspension, or termination of the
services, due to the contents, security, accuracy or quality of information
made available on the site or received or transmitted through the services
or otherwise;
any loss or damage sustained in connection with your use or
inability to access the services or any disclosure (inadvertent or
otherwise) of any information concerning your account or particulars or for
any error, omission or inaccuracy with respect to any information so
disclosed;
any breach, violation, non-compliance or infringement of any
laws, rules and/or regulations by you, by a merchant, by a delivery agent or
by any other person, in connection with the use of this site and the
services or products provided hereunder.
No statement, whether oral or written, made or obtained by you from
MeaPhone.com, from the site, in connection with the services or otherwise
will serve to create any representation or warranty not expressly made
herein. MeaPhone.com shall not be responsible or under any obligation to
maintain, provide or to assist in providing historical records or data
relating to your transactions carried out using the services.
9. The liability of MeaPhone.com, its Resellers, or any of its
affiliated, employees, agents or service providers arising from misdelivery,
non-delivery, or any other errors or omissions in the provision of the
services is limited to an amount equal to the charge for any such services.
10. No failure on the part of MeaPhone.com to exercise and no delay on
its or their part in exercising, any right or remedy under these Terms and
Conditions will operate as a waiver thereof, nor will any single or partial
exercise of any right or remedy precluding other or further exercise thereof
or the exercise of any other right or remedy.
11. All trademarks, service marks and trade names used on or in
connection with the site and the services or these Terms and Conditions are
proprietary to MeaPhone.com or to their respective owners.
